CONFISCATION OF A FIREARM SUBSEQUENT TO AN UNLAWFUL USE OF A WEAPON OFFENSE DEFINED

After a conviction where a weapon was used or possessed by the defendant, the trial court will confiscate the weapon seized if it is no longer needed as evidence and return it to its legal owner, unless such owner cannot be found or is dead, at which point the weapon will be destroyed by the sheriff or used at their discretion for official purposes.
